Welcome to maisondulval.com (the "Site"), the official online home of Maison Dulval ("Maison Dulval," "the company," "we," "us," or "our"). These Terms of Service (the "Terms") set out the agreement between you and Maison Dulval whenever you visit the Site, register an account, place an order, or otherwise make use of any service we offer. We ask that you read this document carefully before completing a transaction, as proceeding to checkout indicates your acceptance of every provision below.

If you do not agree with any portion of these Terms, please refrain from using the Site.

1. Definitions

For ease of reading, certain words appear throughout this document with specific meanings:

"Customer," "you," and "your" refer to any individual visiting the Site or purchasing from it.
"Goods" refers to any product offered for sale on the Site.
"Order" refers to any request you submit through the Site to purchase Goods.
"Content" refers to text, images, photography, illustrations, videos, logos, code, and any other material displayed on the Site.

2. Eligibility

When you access the Site, you represent that you have attained the age of eighteen (18) years, or alternatively that you are doing so under the direct supervision and with the express consent of a parent or legal guardian. Accounts opened or orders placed by minors without such consent are not authorised and may be cancelled at our discretion.

3. Account Registration

You may choose to create a customer account to streamline future purchases. When doing so, you are responsible for:

Providing accurate, current, and complete information at the time of registration
Keeping your login credentials confidential and secure
All activity that takes place under your account, whether or not authorised by you

We reserve the right to suspend or close any account where we suspect fraudulent activity, breach of these Terms, or misuse of our services.

4. Order Acceptance and Formation of Contract

Submitting an Order through the Site constitutes an offer by you to purchase the Goods listed. No binding contract exists until we have issued a written order confirmation by email. We retain the discretion to refuse or cancel any Order at our sole discretion, including but not limited to situations involving:

Errors in the product description, image, or price
Suspected fraud or unauthorised use of payment methods
Limitations on quantities available for purchase
Shipping restrictions affecting your delivery address

Where we cancel an Order after payment has been taken, the full amount will be refunded to the original payment method without delay.

5. Product Information and Availability

We take reasonable steps to ensure that every product appearing on the Site is described and depicted accurately. Even so:

Photography may not capture exact colours, finishes, or textures, due to variations between screens and lighting environments.
Inventory levels can change rapidly. Listing a product on the Site does not amount to a guarantee that it remains available at the time you place your Order.
We may, at any time and without prior notice, withdraw, discontinue, or alter the specification of any item offered for sale.

6. Pricing

Pricing across the Site is quoted in United States Dollars (USD) and is exclusive of applicable taxes, duties, and delivery charges, which will be calculated and displayed at checkout.

While we work hard to keep our pricing accurate, errors do occasionally occur. If a pricing error is discovered after you have placed an Order, we will contact you with the correct price and the option to either confirm the Order at the corrected amount or cancel it for a full refund.

7. Payment

We accept the major credit and debit cards displayed at checkout, in addition to any alternative payment methods made available from time to time. By submitting payment, you represent and warrant that you are the rightful holder of the card or account being used, and that sufficient funds are available to cover the transaction. Orders will not be processed until payment has cleared in full, and we retain the discretion to cancel any Order where authorisation has been refused.

8. Promotional Codes and Discounts

From time to time we may issue promotional codes, gift vouchers, or other discounts. Unless explicitly stated:

Codes cannot be combined with other offers
Codes carry an expiry date after which they cease to function
Codes are non-transferable and hold no cash value
We reserve the right to withdraw any promotion at any time, and to refuse codes that we believe have been obtained or used in violation of these Terms

9. Shipping and Delivery

Our shipping framework, including handling timelines, carrier options, and estimated transit windows, is detailed in our separate Shipping Policy, which forms part of these Terms by reference. Any timeframe we communicate is provided in good faith as an estimate and should not be treated as a binding commitment. We do not accept liability for delays attributable to events beyond our reasonable control, including but not limited to carrier disruption, severe weather, customs processing, or other force majeure occurrences.

10. Risk and Title

Title to and risk of loss in any Goods passes to you at the moment the courier hands the parcel over at your delivery address (or, where applicable, to a designated recipient).

11. Returns and Refunds

The conditions under which Goods may be returned or exchanged are set out in full in our Return & Refund Policy, which forms part of these Terms by reference. We recommend reviewing that document before completing any purchase.

12. Permitted Use of the Site

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only.

13. Prohibited Conduct

You agree that you will not:

Use the Site for any unlawful, fraudulent, or harmful purpose
Attempt to access areas of the Site, servers, or networks that you are not authorised to access
Reverse engineer, scrape, harvest, or otherwise extract data from the Site by automated means
Interfere with, disrupt, or place unreasonable load on the Site or its underlying infrastructure
Upload viruses, malware, or any other malicious code
Impersonate any person or misrepresent your affiliation with any individual or entity
Reproduce, redistribute, or otherwise exploit any Content without our prior written consent

Breach of any of the above may result in immediate termination of your access to the Site, in addition to any other remedies available to us at law.

14. Intellectual Property

All Content appearing on the Site, including the name Maison Dulval, our logos, product names, photography, illustrations, written copy, and the design and layout of the Site itself, is the exclusive property of Maison Dulval or its licensors, and is protected by United States and international intellectual property laws. Nothing on the Site grants you, by implication, estoppel, or otherwise, any licence or right to use any of our intellectual property except as expressly set out in these Terms.

15. User-Submitted Content

If you submit reviews, comments, photographs, or any other material to the Site or to Maison Dulval directly, you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sub-licensable licence to use, reproduce, modify, publish, and display that material in connection with the operation and promotion of our business. You represent and warrant that any material you submit is your own work, does not infringe the rights of any third party, and does not contain anything unlawful, defamatory, obscene, or otherwise objectionable. We reserve the right to remove user-submitted content at our discretion.

16. Third-Party Links and Services

The Site may contain links to or integrations with services operated by third parties. These are provided for your convenience only, and we do not endorse, control, or accept responsibility for the content, products, or practices of any third-party site or service. Your interactions with third parties are governed by the terms and policies of those parties, not by these Terms.

17. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms by reference. By using the Site, you acknowledge that you have read and understood that policy.

18. Disclaimer of Warranties

The Site, and all Content and Goods offered through it, are provided on an "as is" and "as available" basis. So far as the law permits, Maison Dulval disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no representation that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

19. Limitation of Liability

So far as the law allows, Maison Dulval, its officers, employees, agents, and affiliates will not be liable for:

Indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
Any loss of profits, revenue, data, goodwill, or business opportunity
Any damages arising out of your use of, or inability to use, the Site or any Goods purchased through it
Any damages caused by events outside our reasonable control

Where liability cannot be excluded under applicable law, our aggregate liability to you in connection with any single Order shall not exceed the total amount paid by you for the Goods that gave rise to the claim.

Nothing in these Terms operates to exclude or limit liability that cannot lawfully be excluded or limited, including liability for fraud or death or personal injury caused by negligence.

20. Indemnification

You agree to indemnify, defend, and hold harmless Maison Dulval and its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your breach of these Terms
Your misuse of the Site or any Content
Your violation of any law or the rights of any third party

21. Force Majeure

Maison Dulval shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, civil unrest, government action, strikes, courier or supplier failures, internet outages, or cyber attacks.

22. Termination

We may, at our sole discretion and without prior notice, suspend or terminate your access to the Site if we believe you have breached these Terms or engaged in conduct that may damage our business, reputation, or other customers. Termination does not affect any rights or obligations that have accrued before the date of termination.

23. Dispute Resolution

Informal resolution. Before commencing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at customercare@maisondulval.com and setting out the nature of the complaint. We will work with you in good faith to find a resolution within thirty (30) days of receiving your notice.

Binding arbitration. If the dispute cannot be resolved informally, both parties agree that any claim arising out of or relating to these Terms or your use of the Site shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. To the extent permitted by law, you and Maison Dulval agree to bring any dispute on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative proceeding.

24. Governing Law and Jurisdiction

These Terms shall be interpreted and enforced under the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Where arbitration does not apply, you agree that the state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute.

25. General Provisions

Entire agreement. These Terms, together with the Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Maison Dulval regarding your use of the Site, and supersede any prior agreements between us on the same subject matter.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights freely.
Notices. Notices to Maison Dulval should be sent in writing to customercare@maisondulval.com. Notices to you will be sent to the email address you provided at registration or checkout.

26. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our business, our services, or applicable law. The current version will always be available on this page, marked with the most recent effective date. Continued use of the Site after revisions have been posted constitutes your acceptance of the updated Terms.
